These Terms of Use ("Terms") constitute a legally binding agreement between you and the developer of Sage: Menopause Tracker ("Sage", "we", "us"). Please read them carefully before downloading or using the app. By downloading or using Sage, you agree to be bound by these Terms. If you do not agree, do not use the app.
Critical notice: Sage is a personal self-reporting diary. It is not a medical device, does not provide medical diagnoses, and does not offer medical advice. Never use Sage as a substitute for professional medical care. Always consult a licensed healthcare provider for any health concerns.
Sage: Menopause Tracker is a personal symptom-tracking application for iOS designed for women navigating perimenopause and menopause. It allows users to log daily symptoms, identify patterns, track triggers, and generate PDF reports for personal use and discussion with healthcare providers.
Sage is intended for informational and self-tracking purposes only. It is not cleared or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device.
You must be at least 18 years of age to use Sage. By using the app, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not use Sage.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Sage on an iOS device that you own or control, solely for your personal, non-commercial purposes.

This license is also subject to Apple's App Store Terms of Service, which are incorporated herein by reference.
Sage offers a free tier and an optional Premium subscription. All subscriptions are managed through and billed by Apple via the App Store.
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled. Your Apple ID account will be charged within 24 hours prior to the end of the current period. Renewal prices are subject to change with notice.
Cancellation: You may cancel at any time through Apple ID Settings → Your Name → Subscriptions → Sage. Cancellation takes effect at the end of the current billing period. You retain access to Premium features until that date.
Refunds: We do not offer refunds for subscription fees already charged, except as required by applicable law or Apple's refund policies. To request a refund, contact Apple directly through reportaproblem.apple.com.
Price changes: We reserve the right to modify subscription prices. We will provide reasonable advance notice of any price changes. Your continued subscription after the price change takes effect constitutes acceptance of the new price.
All data you enter into Sage — symptoms, moods, notes, triggers, quick logs, and preferences — is stored locally on your device. You own your data entirely. We do not access, collect, store, or process your health data on any server.

We are not responsible for any loss of data resulting from device loss, damage, theft, failure, or your choice to delete the app or its data.
Sage is a personal wellness and self-tracking tool. The following apply without exception:
You agree to use Sage only for lawful purposes and in accordance with these Terms. You agree not to use Sage in any way that violates applicable federal, state, local, or international law; to transmit unsolicited advertising; to impersonate any person or entity; or to engage in any conduct that restricts or inhibits anyone's use of the app.
Sage and its original content, features, design, and functionality are and will remain the exclusive property of the developer. Sage is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.
The Outfit font used in Sage is licensed under the Open Font License. Firebase, RevenueCat, and other third-party services are the property of their respective owners.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAGE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OBTAINED FROM USING THE APP WILL BE ACCURATE OR RELIABLE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAGE, ITS DEVELOPER, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless the developer and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of Sage.
Sage integrates with third-party services including Firebase (Google LLC), RevenueCat, and Apple's App Store. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.
We reserve the right to terminate or suspend your access to Sage at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your license to use Sage terminates immediately. Sections 6, 8, 9, 10, 11, and 14 shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the app that cannot be resolved informally shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA), and not in a court of law. You waive your right to participate in class action lawsuits or class-wide arbitration.
To initiate a dispute, contact us first at hello@sagetracker.app. We will attempt to resolve any dispute informally within 30 days before arbitration may be initiated.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top and, for material changes, provide notice through the app. Your continued use of Sage after the revised Terms take effect constitutes your acceptance of the changes.
These Terms, together with our Privacy Policy and Apple's App Store Terms of Service, constitute the entire agreement between you and us regarding Sage and supersede all prior agreements, understandings, or representations.
